Terms and conditions of the promotional action "Free DPD Pickup delivery".

§ 1
Definitions
The terms used in these Terms and Conditions (hereinafter: "Terms and Conditions") shall mean:
1. "Terms and Conditions" - these Rules of the Promotional Action binding on the Organiser, Participants, setting out the terms and conditions of the Promotional Action.
2. "Promotional Action" - a Promotional Action conducted under the terms of these Terms and Conditions.
3. "Organiser" - the Organiser of the Promotional Campaign:
Red Bird Sp. z o. o. with its registered office in Łódź 94-439 Łódź, Lublinek 49 , NIP 727 27 87 727, REGON 101499139, entered in the Register of Entrepreneurs by the District Court for Łódź Śródmieście in Łódź, XX Division of the National Court Register KRS 0000438905, with a share capital of PLN 70,000.00.

4. "Online Shop" - the Organiser's online shop, available at the following address

5."Participant" - a natural person with full legal capacity,
residing in the territory of the Republic of Poland, legal person, including
entrepreneur, having its registered office in the territory of the Republic of Poland, participating in the Promotional Campaign.

6. "Shopping Cart" - a subpage of the Organiser's Online Shop, available at:

7. Product" - a Product covered by the Promotional Campaign, available in the offer of the Organiser's Internet Shop

8. "DPD PickUp Delivery" - the delivery service for a Product ordered as part of the Promotional Action.
Promotional Action "Free DPD PickUp Delivery".
9.DPD PickUp" - a form of collecting an order placed as part of the Promotional Action Promotional Action.
§ 2
General provisions
1. In relation to the Participants, the Organiser is the promisor of free delivery to DPD PickUp points, of products meeting the requirements specified herein and covered by the Promotional Campaign under the terms and conditions indicated therein, within the meaning of Article 919 of the Act of 23 April 1964 Civil Code (Journal of Laws of 2017, item 459, as amended, hereinafter referred to as the Civil Code) in exchange for performing the actions indicated in the Regulations.
2. The Promotional Action does not constitute a promotional lottery within the meaning of the Act of 19 November 2009 on gambling games (Journal of Laws of 2018, item 165, as amended).
3. The Promotional Campaign is conducted via the Organiser's online shop.
4. The Promotional Action lasts from 9.02.2024 until 19.02.2019 or until the products included in the Promotional Action are sold out sooner.
5. The Promotion is cumulative with other promotions. The Organiser reserves the right to extend the term of the Promotional Action for a limited period of time.
6. The subject of the Promotional Campaign is to enable the Participant to purchase a Product from the Organiser's online shop offer covered by the Promotional Campaign, with free delivery of the order to DPD PickUp points.
7. Products that do not fit into DPD PickUp boxes/pick-up points are excluded from the promotional action. All orders consisting of several products which together exceed the dimensions allowing the package to be placed in a partner box/pick-up point will be excluded from the promotional campaign.

8. The organiser is not responsible for the promotional action organised by DPD PickUp and is not a promisor within the meaning of the Civil Code with regard to the promotional action organised by DPD PickUp.
9.The Promotional Campaign is conducted exclusively in the territory of the Republic of Poland.
§ 3
Rules of participation in the promotional campaign
1. Participation in the Promotional Action is voluntary.
2. A necessary condition for participation in the Promotional Action is:
a) Adding by the Participant to the Basket of the Product covered by the Promotional Action.
Products added to the Basket must collectively meet the conditions for free delivery in terms of dimensions.
b) selecting DPD PickUp as the delivery method
c) the cost of delivery to the DPD PickUp will be zeroed in the summary, provided that the product or products meet the free delivery conditions
d) finalise your order and make payment.
3. The order so placed will be prepared by the Organiser and dispatched free of charge to the point of the Participant's choice, in accordance with the carrier's regulations and within the timeframe specified by the carrier:.
4. The organiser is not responsible for the timing of the delivery of the product to the collection point.
5. Products which do not fit into DPD PickUp boxes are excluded from participation in the Promotional Action - maximum dimensions and weight of parcels:
Maximum weight up to 20kg, dimensions max. 50x44x59 cm.
For Żabka network: weight up to 10kg,max. dimensions: 60x40x40 cm.
6. A person who has purchased the Product via Allegro.pl is excluded from participating in the Promotion Action. Such a person is not entitled to the status of a Participant.
7. Participants are not entitled to receive the cash equivalent of the value of the delivery.
8. The Participant acknowledges that the purchase invoice will indicate a delivery price of £0 in accordance with the rules of the Promotional Action. The Participant has no claim to have the delivery value indicated on the invoice.
§ 4
Exclusion of the Participant from the Promotional Action
The Organiser shall have the right to exclude the Participant from participation in the Promotional Action with immediate effect in a case in which the Participant fails to meet the conditions entitling him/her to take advantage of the Promotional Action, as well as in a case in which the Organiser becomes aware of the Participant's actions contrary to the law or the provisions of these Regulations.
§ 5
Responsibility
The Participant is responsible for providing the correct data necessary to fulfil the Organiser's obligations in connection with the Promotional Action.
§ 6
Complaints and returns
1. Complaints concerning the course of the Promotional Campaign may be filed by Participants at the e-mail address of the Organiser: reklamacje@redbird.pl.
2. The Participant has the right to lodge a complaint within 3 days of placing an order and no later than 14 days after the end of the Promotional Action.
3. The complaint should contain the first name, surname, exact address of the Participant, as well as a detailed description of the facts and an indication of the reason for the complaint together with the date on which the event giving rise to the complaint occurred.
4. Complaints will be dealt with immediately, no later than 30 days, from the day the Organiser receives the complaint.

§ 7
Personal data
1. The processing of personal data shall be carried out in accordance with the principles provided for in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (RODO) and the Personal Data Protection Act of 10 May 2018. (i.e. Journal of Laws 2018, item 1000).
2. Personal data of the Participants of the Promotional Campaign, within the scope of handling the sales process within the scope of the Promotional Campaign, are administered by: Red Bird Sp. z o. o. with its registered office in Łódź 94-439 Łódź, ul. 3. Co-administration is carried out under the regulations resulting from Art. 26(1) RODO

5. Dane osobowe uczestników i zwycięzcy będą przetwarzane w następujących celach:
a. the organisation and conduct of the Promotional Campaign - legal basis Article 6(1)(b) RODO, i.e. the processing is necessary for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject prior to entering into a contract
b. for tax and accounting reporting purposes, - legal basis Article 6(1)(c) RODO, i.e. the processing is necessary for the fulfilment of a legal obligation incumbent on the controller
c. for marketing purposes - the data subject has consented to the processing of their personal data for one or more specified purposes.
6. The provision of personal data by the Participant is voluntary, but necessary to participate in the Promotional Action.
§ 8
Final provisions
1. The Terms and Conditions are available in the Online Shop and at the Organiser's head office.
2. Any information about the Promotional Action contained in any other material, in particular promotional and advertising material, is for information purposes only.
3. Before entering the Promotional Action, the Participant is obliged to read the Terms and Conditions.
4. The Organiser reserves the right to amend the Terms and Conditions as long as they do not worsen the conditions of participation in the Promotional Campaign. The amendment shall come into force upon its announcement on the Organiser's website.
5. In matters not regulated by these Terms and Conditions, the provisions of the Terms and Conditions of the Organiser's Internet Shop - available at the Organiser's registered office and on the website - shall apply https://kubekcontigo.pl/Regulamin-sklepu-KubekContigo-pl-cterms-pol-58.html and the provisions of Polish law.
6. These Regulations shall enter into force as soon as they are posted on the Organiser's Website..
